ELIGIBILITY: To be eligible to participate in Digital Playground's "Pirates Display Contest" ("Contest") you must be an owner of a retail store licensed to sell and currently carrying the Digital Playground Inc. ("Digital Playground") motion picture production "Pirates: Stagnetti’s Revenge™" ("You" or "Contest Participant"). All Contest Participants must be adults at least 18 years of age (21 years of age where 18 years is not the age of majority) at time of entry. Contest offer is void where prohibited by law and in ANY AREAS THAT CANNOT LEGALLY RESELL DIGITAL PLAYGROUND PRODUCTS. Your Pirates Display Contest entry MUST be fully operational in the retail store in which you are employed continuously from the time it is submitted until the end of the Contest, December 31, 2008. 2. HOW TO ENTER: Contest begins at 12:00 PM Pacific Time on September 2, 2008 and ends at 11:59 PM on December 31, 2008 respectively ("the promotion period"). To enter the Contest: a. Create and design a "Pirates" display in your store ("Pirates Display"). b. Enter and upload your store name, email address, street address and phone number of retail store that employs you, along with digital photos of your display (up to 4) online at www.DigitalPlayground.com/contest . c. You may use photographs or video clips, etc. that Digital Playground, Inc. makes available for Contest use by engaging the "Download" link located on the Digital Playground web site at www.digitalplayground.com/contest ("Licensed Materials"). Subject to compliance with all the Contest terms, conditions and restrictions set forth in these Rules, Digital Playground hereby grants you a limited license to use such Licensed Materials for the limited purpose of use in your Pirates Display and Contest entry until the end of the Contest. Your limited license to use the Licensed Materials shall terminate at the end of the Contest at 11:59 PM on December 31, 2008, and all use of the Licensed Materials by you shall end at that time unless you obtain express written permission to continue such use from Digital Playground. d. The Pirates Display you create may contain photographs, videos, graphics and other content depicting inanimate objects as long as you have all the required rights to use the depictions and the use does not violate any Contest rules. You may not, however, use any depictions of people other than those depictions made available for Pirates Display Contest use in the Licensed Materials. 2. NOTIFICATION OF WINNERS: Accepted Contest entries Displays will be voted for online at www.DigitalPlayground.com/contest. Any adult person 18 years of age or older, (21 years in locations where 18 years is not the age of majority) is eligible to vote. Digital Playground will accept one vote per unique email address. Winners will be notified on January 5, 2009 or as soon as they can be reached. To qualify for the grand and runner up prizes, displays must receive a minimum of 20% the total votes divided by the number of displays entered. The store display earning the highest rank, with at least the minimum number of votes, will receive $10,000 US dollars. The display earning the 2nd highest rank, with at least the minimum number of votes, will receive $5,000 US dollars. The 3rd place winner, with at least the minimum number of votes, will receive $2,500 US dollars. The store displays earning the 4th – 10th highest ranks, with at least the minimum number of votes, will receive 5 signed copies of “Pirates: Stagnetti’s Revenge” on Blu-ray, 5 signed copies of “Pirates: Stagnetti’s Revenge” on DVD, and 10 signed posters by Jesse Jane®. The store displays earning the 11th – 20th highest ranks, with at least the minimum number of votes, will receive 5 signed copies of “Pirates: Stagnetti’s Revenge” on Blu-ray and 5 signed posters by Jesse Jane. The store displays earning the 21st – 40th highest ranks, with at least the minimum number of votes, will receive 5 signed copies of “Pirates: Stagnetti’s Revenge” on DVD and 5 signed posters by Jesse Jane. The store displays earning the 41st – 50th highest ranks, with at least the minimum number of votes, will receive 1 signed copy of “Pirates: Stagnetti’s Revenge” on Blu-ray and 1 signed poster by Jesse Jane. In the unlikely event of a tie, Digital Playground will divide the ranked award, plus the next sequentially ranked award amongst the tying contestants. 3. Contest Restrictions and Conditions For Use of Licensed Materials. By submitting a Contest entry, you acknowledge and agree that the Contest, your participation in the Contest, and your use of the Licensed Materials are all subject to all applicable federal, state and local laws and to the following restrictions and conditions: a. Except for the Licensed Materials, you may not use any photographs, video clips, music, sounds, dialogue, voices, trademarks, service marks, graphics, text or any other materials of any kind in the Pirates Display that are not exclusively owned by you. All Pirates Displays containing any other company's photographs, video clips, products, services, trademarks, service marks, brand names or other materials will be disqualified immediately and will automatically terminate your right to use the Licensed Materials. Any use of the Digital Playground trademarks, including "Digital Playground®", " Jesse Jane®", "Virtual Sex®", "Pirates II: Stagnetti’s Revenge" or any of Digital Playground's photographs, videos or other content in association with any other company shall also constitute an infringement of Digital Playground's intellectual property rights. b.Your Pirates Display and Contest entry may not contain any recording or depictions of any person who was under the age of eighteen years at the time the recording or depiction was created. c.Your Pirates Display and Contest entry may not contain any materials of any kind that are illegal or harmful, and shall only contain materials for which you have the clear and unrestricted rights to use for the purposes contemplated by the Contest. d.Your Pirates Display and Contest entry may not contain any derogatory, inflammatory, malicious, hateful, harmful or obscene images, graphics, text, or other materials, or any dangerous materials or functionality, of any kind. The Pirates Display and Contest entry shall not contain any materials or shall be used in any manner by you that violates the rights of any person or entity or violate any law, regulation, rule, custom or protocol. e.If your Pirates Display Contest entry contains any nudity or semi-nudity, or any matter that might be harmful to minors, it may not be displayed in a place in your store where it may be visible by persons under the age of eighteen years. f. Digital Playground reserves the right to verify that all Pirates Display Contest entries actually physically exist as represented in the Contest entry, and were consistently operational and displayed in your store from the time of submission of the Contest entry to Digital Playground through the end of the Contest, December 31, 2008. g. Digital Playground reserves the right to disqualify any Contest entry that Digital Playground determines in its sole judgment might violate the rights of any person or entity, would violate any law, rule, regulation, custom or protocol, or would dilute, disparage, or otherwise damage the reputation of Digital Playground or any of its principals, officers, directors, employees, affiliates, current or former contract stars, directors or other talent, or any other person or entity associated with Digital Playground. h. Contest offer and participation is void where prohibited by law. i. All Contest entries, once submitted, shall immediately become the sole property of the Digital Playground, Inc. and shall not be returned. Digital Playground shall not have any obligation to keep any copies of your Contest entry and no bailment shall be deemed to exist in relation thereto. j. Taxes, expenses and incidentals, including the cost of the materials and labor associated with your Pirates Display and your Contest entry are your sole responsibility. By entering, entrant agrees to abide by and be bound by these official rules. Winners consent to use their name and likeness for advertising / publicity purposes without additional compensation. Entrants hereby release and hold harmless Digital Playground, related entities, affiliates, agencies, employees, officers, directors, attorneys and agents from any and all claims, demands, losses and liabilities arising out of this promotion or use or misuse of the prizes awarded hereunder. Digital Playground assumes no liability or responsibility for damages, losses or injury resulting from this contest or the acceptance or use of the prizes. Sponsor is not responsible for incorrect or inaccurate transcription of entry information or any human error, technical malfunctions, lost / delayed data transmission, omission, interruption, deletion, defect, line failures or any telephone network, computer equipment, software, inability to access any website or online service, or any other error or malfunction, or late, lost, incomplete, illegible, stolen, mutilated or misdirected entries. Entrant is responsible for all transmission costs. Tampering with the voting system, your email or IP address will disqualify your Contest entry immediately and immediately terminate your rights to use Licensed Materials. 4. SPECIAL CONSIDERATIONS, RULE CHANGES AND CONTEST CANCELLATION: Digital Playground reserves the right to disqualify, in its sole discretion, any Contest entrants not believed to be operating with integrity. Digital Playground also reserves the right to modify or otherwise change any rules or cancel the contest without prior notice. Digital Playground may, in its sole discretion, cancel the contest for lack of participation if Digital Playground has received less than twenty (20) bona fide entries by 11:59 PM, December 31, 2008. 5.
